Anup Suresh is an associate in the Intellectual Property Practice Group of the firm's Palo Alto office.

Areas of Practice

Mr. Suresh's practice involves representation of clients in patent prosecution. His representation of clients also involves patent litigation, trademark prosecution, and transaction matters involving intellectual property.

Mr. Suresh's experience includes drafting and successfully prosecuting patent applications, drafting reexamination requests, conducting IP due diligence for business transactions (e.g., IPOs, mergers, acquisitions), performing freedom to operate/right to use analyses, performing non-infringement analyses, and performing landscape analyses. Representative clients include Cadence Design Systems, Inc. and RealD.

In terms of technology, Mr. Suresh's representation has involved such advance technological fields as:

  • Semiconductor Devices, including photolithography [e.g., double patterning, phase-shift masks (PSM), optical proximity correction (OPC)], general fabrication processes [e.g., floorplanning, placement and routing, design rule checking (DRC), layout versus schematic (LVS) check, and design for manufacturability (DFM)], general circuit design tools [e.g., electronic design automation (EDA) tools].
  • Analog and Digital circuit design, including transmitters and receivers, tuners, filters, power distribution and conversion systems [e.g., electro-mechanical, AC/DC converters].
  • Communications Systems, including cellular networks (e.g., CDMA, TDMA, GSM, SMS, over-the-air administration), digital communications [e.g., OFDM, QAM], networking [e.g., routers, switches, 802.11x, MoCA, MAC/PHY layers], VoIP [e.g., SIP, Asterisk], and telephone systems [e.g., private branch exchange (PBX) systems, public switched telephone networks (PSTNs), circuit switching, Signaling System #7 (SS7)].
  • Medical device, including ophthalmic lenses, and shunt.
  • Global Positioning Systems, including antenna design and GPS receivers.
  • Hard drive technologies, including magnetic media, read/write hardware, and manufacture of substrates.
  • Data storage and communication, including network area storage (NAS) systems, data backup, data de-duplication, and network congestion reduction.
  • Game Controllers and Accessories, including feedback devices, wireless controllers, and biosensors.
  • Secured Transaction Systems, including encryption/decryption, authentication, and secured magnetic card readers.
  • Imaging Systems, including optical systems, and holography.
  • Green Technologies, including fuel injector systems, green building construction, and photovoltaic systems.

In terms of patent litigation, Mr. Suresh has worked on a number of patent infringement actions concerning advanced technologies, such as data de-duplication, telecommunication networks, and cellular networks. Some representative cases include:

  • Mformation Technologies, Inc. v. Research in Motion, Ltd. (“RIM”). Assisted in the representation of Mformation in its patent infringement suit accusing RIM’s BlackBerry devices and related software of infringing Mformation’s patents relating to remote management of wireless devices.
  • Quantum Corp. v. Riverbed Technologies, Inc. Assisted in the representation of plaintiff and cross-defendant Quantum in multiple patent infringement lawsuits against Riverbed regarding data storage products that utilize data de-duplication technology. The matters were resolved in a very favorable global settlement for Quantum.
  • Telarix, Inc. v. Vero Systems, Inc. Assisted in the representation of defendant Vero Systems in a patent infringement suit regarding software for least-cost routing of international telephone calls. Settled favorably.

Prior to joining Sheppard Mullin, Mr. Suresh worked for a number of years at Boeing as a software embedded engineer. He developed avionics software for both the C-17 military transport and the C-130 military transport. Technical experience gained from these avionics programs include ADA-95 programming, MIL-STD-1553, ARINC-429, and software testing. Mr. Suresh also worked for a technology start-up, called Neutrino Technologies, Inc., which developed natural language search software.

Representative Experience

Mr. Suresh has prosecuted patents for companies such as Physical Optics Corp., Western Digital Corp., Transonic Combustion, Inc., Cadence Design Systems, Inc., Performance Designed Products LLC, Topcon Corporation, and Semtek Innovative Solutions Corp. (now part of VeriFone Systems).

Mr. Suresh has performed intellectual property (IP) due diligence work for the $230 million initial public offering (IPO) of ReadlD, for a transaction involving the acquisition of a security software company, and for several investments made by a large venture capital firm.

Mr. Suresh has been involved in the following litigation matters:

  • Mformation Technologies, Inc. v. Research in Motion, Ltd. (“RIM”). Assisted in the representation of Mformation in its patent infringement suit accusing RIM’s BlackBerry devices and related software of infringing Mformation’s patents relating to remote management of wireless devices. 
  • Quantum Corp. v. Riverbed Technologies, Inc. Assisted in the representation of plaintiff and cross-defendant Quantum in multiple patent infringement lawsuits against Riverbed regarding data storage products that utilize data de-duplication technology. Mr. Suresh is currently assisting in a litigation involving a large mobile device manufacturer.
