Mr. Katz specializes in business bankruptcies and creditors' rights. He has represented debtors, individual creditors, creditors' committees, parties purchasing assets out of bankruptcy and parties involved in bankruptcy litigation. He has represented chapter 11 debtors in a wide range of industries, including real estate, retail, construction, biotech, telecommunications and internet businesses. Represented Diageo North America, Inc. in connection with various matters relating to the Chapter 11 bankruptcy filing of a California grape farmer and a dispute involving the rejection of a grape purchase agreement covering hundreds of acres of vineyards. The Bankruptcy Court entered an order approving Diageo's motion to compel the debtor to reject the grape purchase agreement and the Bankruptcy Appellate Panel for the Ninth Circuit affirmed on appeal.
Represented General Electric Capital Corporation in connection with its successful application for an appointment of a receiver over a recreational vehicle resort known as Pacifica Park RV Resort.
Represented Douglas Wilson as the court-appointed receiver of a thirteen story office space in Santa Clara, California known as Regency Plaza. The receiver was successful in recovering approximately $3 million in assets that had been transferred to insiders in the months prior to the receiver's appointment.
Represented official committee of unsecured creditors of Standard Media International aka The Industry Standard in connection with the sale of portions of the Debtor's business and the orderly liquidation of the Debtor's assets, resulting in significant distribution to general unsecured creditors.
Represented Advanced TelCom Group, Inc. and three of its affiliates in connection with confirmation of a successful Chapter 11 plan of reorganization, culminating in the continued operations of the Debtors' telecommunications businesses in various markets on the West Coast.
