Mark A. Geier is an associate in the Intellectual Property Practice Group in the firm's Del Mar Heights Office.
Areas of Practice
Mr. Geier has experience in handling a wide variety of intellectual property matters, primarily for clients in the biotechnology, pharmaceutical, medical device, high technology and software industries, including licensing and other transactional matters, patent litigation and appeals, and patent prosecution and strategic counseling.
Mr. Geier handles technology transactions and licensing matters such as acquisition and protection of intellectual property, technology transfer agreements, patent and software licensing transactions, development and research collaborations, marketing agreements, co-promotion and distribution agreements, and professional services agreements. Mr. Geier has represented biotechnology, medical device, software, and other high technology companies in his transactional practice. Representative clients include Broadcom Corporation, MicroIslet Inc., Amgen and Gen-Probe Inc.
Mr. Geier prepares and prosecutes patent applications and provides strategic counseling to clients regarding their intellectual property matters. His strategic counseling practice has included drafting noninfringement and invalidity opinions, preparing freedom to operate analyses, conducting patent searches and IP due diligence, and drafting oppositions to European patents. Mr. Geier has drafted and prosecuted patents relating to medical devices and procedures, biotechnology (including in the areas of stem cell research and immunology), software, and business methods. Mr. Geier has experience with patent prosecution in the United States and internationally.
Mr. Geier also represents clients in litigation matters involving patents and trademarks. His litigation practice has included patent litigation involving medical devices, chemical processes and compositions, and business methods/processes. Representative matters include representation of a medical device company in litigation involving trocars, including an appeal to the U.S. Court of Appeals for the Federal Circuit where he helped obtain a reversal of a noninfringement ruling (Applied Medical Resources Corp. v. U. S. Surgical, 448 F.3d 1324 (Fed. Cir. 2006)), and representation of an advertising/media company asserting patents relating to methods of presenting and displaying advertising. Mr. Geier has substantial experience in discovery, motion practice, and appeals to the U.S. Court of Appeals for the Federal Circuit.
