Gabriel G. Green is an associate in the Business Trial Practice Group in the firm's Los Angeles office. His practice focuses in the areas of intellectual property, franchise, and commercial litigation.
Areas of Practice
As part of his intellectual property practice, Mr. Green handles disputes concerning copyrights, trademarks, and trade secrets. In the copyright arena, Mr. Green has represented corporations and public personalities encountering copyright infringement claims involving musical compositions, video game graphics, sculptural works, jewelry design, and literary works.
In the trademark arena, Mr. Green frequently litigates infringement claims involving trademarks, service marks, and trade dress, as well as claims for trademark dilution and unfair competition. On the prosecution end, he has successfully obtained monetary judgments against infringers who have misappropriated the rights to registered and unregistered marks. Mr. Green also has obtained equitable relief for trademark holders in both State and Federal Courts to ensure future protection of their valuable trade and service marks. On the defensive end, Mr. Green has successfully litigated infringement claims involving trademarks, service marks, and trade dress. In addition, he has successfully defended against claims for trademark dilution, unfair competition, and rights to publicity.
Mr. Green's franchise litigation practice derives from his representation of nationally and internationally renowned franchisors with brands in a range of industries. Understanding the valuable aspects of a franchised system, Mr. Green has obtained affirmative relief for franchisors against third-parties misappropriating a brand mark and/or a franchised trade secret. He also has obtained injunctive as well as monetary relief against franchisees breaching their operative franchise agreements and/or otherwise harming the franchised brand. In addition, Mr. Green has obtained favorable judgments for franchisors encountering vicarious liability claims based on conduct of a franchisee, frequently obtaining judgment on the merits in the early stages of litigation.
With regard to his commercial litigation practice, Mr. Green has successfully represented corporate clients charged with misappropriating trade secrets and/or accused of intentionally interfering with another's contractual relationship. Mr. Green also has successfully prosecuted breach of contract claims involving a business debtor's failure to satisfy its obligations, a business partner or associate's failure to recognize its contractual duties, and a former employee's refusal to acknowledge his/her post employment covenants. Similarly, Mr. Green has obtained positive results in cases involving allegations of breaches of fiduciary duties and/or professional negligence. In addition, Mr. Green counsels clients involved in commercial real estate disputes, frequently representing landlords in disputes concerning their commercial clients. He has prosecuted, and defended, lawsuits related to the purchase and sale of multi-million dollar real estate transactions.
