Daniel C. Kloke is an associate in the Intellectual Property Practice Group in the firm’s Silicon Valley office.

Areas of Practice

Mr. Kloke specializes in intellectual property law with an emphasis on patent prosecution, strategic patent counseling, patent litigation, drafting and negotiating intellectual property licensing agreements, and counseling on open source as well as standards-setting issues.  Mr. Kloke has also prepared numerous appeals and noninfringement opinions as well as participated in reexamination proceedings and patent litigation related to Lemelson v. Via Technologies.  In addition to his patent practice, Mr. Kloke has extensive experience as a litigating attorney in complex commercial litigation matters.

Prior to joining Sheppard Mullin, Mr. Kloke was a patent attorney with Carr & Ferrell LLP, a firm specializing in venture backed startup and growth companies.  Before being an attorney, Mr. Kloke enjoyed a career as a computer and network systems engineer.  As a Network Administrator at the University of Pittsburgh, School of Law, Mr. Kloke worked to create the Computer Services Department as well as design and implement the many computer and network systems. Additionally, while receiving his electrical engineering degree, Mr. Kloke worked closely with the Boeing Company and others from a variety of other engineering fields to design a rocket payload system capable of controlled flight, GPS telemetry, and wireless video reconnaissance.

Over his career, Mr. Kloke has worked closely with clients to create market power and promote valuation through implementation of sound legal strategies to leverage intellectual property assets and investments. In addition to intellectual property portfolio development, Daniel has assisted businesses and counsel to analyze patents and other intellectual property to prepare for and support offensive as well as defensive litigation.
