Ms. Molly Newland is an associate in the Business Trial practice group in the firm's San Francisco office.

Areas of Practice

Ms. Newland is experienced in litigating a wide variety of cases in federal and state courts involving consumer class actions, intellectual property, securities, and contractual disputes. Her focus is in the area of complex consumer class action defense in a wide array of industries, including consumer credit, automobile financing and securities. She has experience handling litigation on behalf of companies from both the plaintiff and defense perspectives. Ms. Newland has significant experience in all aspects of the litigation practice including drafting and opposing pleadings, substantive motion practice including appearing to argue motions in both state and federal court. She also has exceptional experience in litigation and discovery management, including electronic discovery, taking and defending depositions, and all types of written discovery in putative class actions, patent infringement lawsuits, and other civil litigation.

Represents AmeriCredit and Toyota Motor Credit in class actions challenging adequacy of post-repossession notices used in connection with motor vehicle loans, required under Rees-Levering Automobile Sales Finance Act, California Civil Code Section 2981, et seq.

Represents Hertz in class action challenging pass-through of airport concession recovery fees in Nevada.

Represents major federal savings and loan bank in various lawsuits in federal and state courts relating to wrongful foreclosures and related claims.

Represented major beverage distributor in litigation and arbitration concerning distribution rights pursuant to California Business and Professions Code ยง 25000.2.

Represented topical drug product development company against information service management company in contractual dispute regarding a clinical drug trial.

Represented major technology licensing company and patent-holder in multidistrict federal patent infringement cases involving interactive call processing, computer telephony and related services.

Represented audit committees of several software companies in conducting internal investigations.

Represented provider of business outsourcing services in trade secrets and copyright infringement case.

Pro Bono

Represents Malagasy asylum applicant based on political opinion and social group affiliation.

Represented Mongolian women in applying for asylum based on domestic violence. Client successfully obtained asylum and permanent residency in the United States.

Represented 12-year old Cameroonian child in applying for asylum based on a forced-marriage arrangement entered into at birth. Client successfully obtained asylum in the United States.

Represented two sets of foster parents in successfully adopting two children/three children. Appeared at Court hearings on behalf of clients to finalize adoptions.
