Rebecca S. Roberts is a litigator and works out of the firm's Del Mar Heights office.

Areas of Practice

Ms. Roberts handles complex civil and criminal litigation in state and federal court.  She has represented clients in civil cases involving securities claims, the Racketeer Influenced and Corrupt Organizations Act, the California Environmental Quality Act, municipal law, insurance, contract disputes and business torts.  Ms. Roberts has also assisted clients with enforcement proceedings before the Securities and Exchange Commission and the National Association of Securities Dealers as well as with internal and governmental investigations.

Representative Matters

Represented the former Mayor of San Diego and the President of the City Council in an SEC investigation and as witnesses in criminal and civil cases pending in state and federal court.  Issues concerned retiree benefits, the funding of the city's pension fund, municipal law and bond offering disclosures.

Represented company executive accused by City Attorney of improperly lobbying city officials.  Won a highly publicized motion to disqualify City Attorney.  Court dismissed all charges. 

Represented mobile entertainment company in an investigation by the National Association of Securities Dealers.  No charges were brought.   

Assisted company investigating employee embezzlement by convincing insurer to pay on the claim, coordinating with the criminal prosecutor and filing a civil case. 

Defended newspaper in intentional interference with contract/ unfair competition lawsuit concerning the development of a comic strip.  Brought successful summary judgment motion which ended case. 

Defended developer in California Environmental Quality Act lawsuit.  Defeated two temporary restraining orders and obtained highly favorable settlement.

Assisted Native American Tribe in obtaining insurance coverage and favorable settlement in a construction defect lawsuit.

Advised clients participating in government as to applicability of municipal and state conflicts of interest laws. 

Conducted internal investigation of a large financial institution's loan modification program.

Conducted internal investigation of stock options backdating on behalf of a U.S. corporation. 

Represented executive in a stock options backdating internal investigation. 

Conducted internal investigation concerning a wrongful death on behalf of a sorority. 

Defended environmental consulting firm in personal injury action.  Brought successful summary judgment motion which dismissed client. 

Assisted company in obtaining insurance coverage in an asbestos litigation case. 

Represented company in Racketeer Influenced and Corrupt Organizations Act and misappropriation of trade secrets lawsuit against former employees.

Brought successful motion to dismiss patent action pending in Delaware for lack of subject matter jurisdiction and venue on behalf of a technology company.

Represented company which manufactured ATM and vending machines in SEC investigation. 

Brought successful motion to set aside entry of default against developer in contract dispute.
