Bridgette Agness is a Special Counsel in the Intellectual Property and Technology Practice Group in the firm’s Los Angeles office.

Areas of Practice

Ms. Agness is a litigator and registered patent attorney with expertise in a broad range of intellectual property matters, including patent litigation, patent prosecution and counseling, patent reexamination and inter partes review proceedings, trademark prosecution and litigation, unfair competition, and intellectual property due diligence.  She has represented high technology clients in patent and trademark matters in several U.S. District Courts, the U.S. Court of Appeals for the Federal Circuit, the International Trademark Commission, and the U.S. Patent and trademark Office.  She has represented companies involved in a diverse range of technologies, including golf equipment, television and motion picture lighting, LED lighting, medical devices, DNA sequencing, e-commerce, optical lenses, optical coatings and thin films, pharmaceuticals, furniture, and gaming.

Representative Matters

Represented well-known golf equipment manufacturer in patent infringement action.  Persuaded the district court to stay the case pending inter partes reexaminations of the patents-in-suit, during which all but four dependent claims were found to be invalid.  Obtained summary judgment (C.D. Cal.) dismissing infringement claims as to the four surviving, reexamined claims.

Represented a leading Hollywood lighting company against claims of infringement of two patents on light diffusion assemblies/boxes.  Obtained summary judgment of non-infringement (C.D. Cal.) on one patent.  Succeeded in invalidating the second patent in inter partes reexamination, which was affirmed by the Federal Circuit on appeal.  Finn v. Rea, 534 Fed. Appx. 999 (Fed. Cir. Oct. 16, 2013).

Represented well-known golf equipment manufacturer in patent infringement action and inter partes reexamination proceedings involving three patents related to customizable golf club heads.  Obtained summary judgment of non-infringement (E.D. Tex.), which was affirmed by the Federal Circuit on appeal.  Dogleg Right Partners, LLP v. Taylormade Golf Co., 470 Fed.Appx. 904 (Fed. Cir. June 19, 2012).

Represented well-known electronic postage company in a patent infringement case involving 11 patents.  Assisted in narrowing the case to only 15 claims, and obtained summary judgment of invalidity of all 15 claims (C.D. Cal.).  Decision was affirmed on appeal by the Federal Circuit.

Represented innovator of real estate virtual tours in patent infringement action against prominent competitor.  Obtained favorable settlement.  Also assisted company in licensing its patented technology.

Represented a leading biomedical instrument manufacturer in a patent infringement action relating to DNA separation technology and incubators for DNA sequencing.  Successfully opposed motions for summary judgment of non-infringement and invalidity (C.D. Cal.).  Case ended with favorable settlement.

Assisted leading manufacturer of optical lenses with filing and prosecution of portfolio of U.S. and foreign patents and trademark registrations.

Assisted leading golf equipment manufacturer with prosecution of patents and IP counseling.

Assisted leading Hollywood lighting company with clearance, filing and prosecution of portfolio of U.S. and foreign trademark registrations and design patents.

Assisted large furniture manufacturer with clearance, filing and prosecution of portfolio of U.S. and foreign trademark registrations.

Assisted search engine provider with licensing of patented technology.
