Kimpo Ngoi is an associate in the Labor and Employment Practice group in the firm's San Francisco office.
Areas of Practice
Mr. Ngoi manages employment and labor disputes in varying forums, from the initial charge or complaint through appeal and settlement. Among Mr. Ngoi's experience is his successful defense of technology, finance, and retail clients against allegations of retaliation, wrongful termination, discrimination, and harassment. In the wage and hour context, Mr. Ngoi has considerable experience litigating representative actions that raise complex questions, such as the wages owed to commissioned sales associates, the classification status of independently licensed counselors, and the job duties potentially subject to suitable seating.
Mr. Ngoi also routinely counsels clients on lawful workforce management practices on a wide range of topics, including structuring nonexempt compensation, protected leaves of absence, and the implementation of reductions-in-force. Most notably, he has provided businesses with guidance on conducting and using background checks in a manner consistent with the federal Fair Credit Reporting Act and corresponding state laws, and local ordinances affecting fair employment.
In his spare time, Mr. Ngoi fundraises on behalf of nonprofit organizations that extend access to legal services to underrepresented and underserved communities.
