Given the increasingly transitory nature of employees and the ease with which business information is digitally portable, employee misappropriation of trade secrets is an increasingly important issue globally. New legislation and recent court activity have changed the landscape as it relates to trade secrets and employee mobility, both in the United States and abroad. As a result, there are new rules and approaches for employers to consider when dealing with employee and information mobility.

This program will provide employers with an update on these new developments, as well as recommended best practices for protecting company trade secrets and responding to a breach. We will cover these issues in both the US and Europe, including the latest developments under the Uniform Trade Secrets Act and related legislation in the US, and the impact on global employers due to the new EU Trade Secrets Directive.

Topics include:

  • Developments under state Uniform Trade Secrets Acts and other proposed legislation
  • The EU Trade Secrets Directive
  • How to respond when employees leave or take confidential information
  • Best practices for protecting your company and avoiding a breach

Speakers:

  • Kevin Cloutier, Partner, Sheppard Mullin
  • Warren Wayne, Partner, Bird & Bird LLP
