Overview

Katie Calogero is an associate in the Governmental Practice in the firm's Washington, D.C. office.

Areas of Practice

Katie represents clients of all sizes in a broad range of government contracts and international trade matters. Her practice includes:

prosecuting and defending pre- and post-award bid protests before the Government Accountability Office (GAO), the U.S. Court of Appeals for the Federal Circuit, the U.S. Court of Federal Claims (COFC), federal government agencies and state and local administrative entities;
representing government contractors in disputes with the federal government, including claims under the Contract Disputes Act (CDA) before the COFC and appeals of contracting officer final decisions to the Armed Services Board of Contract Appeals (ASBCA) and the Civilian Board of Contract Appeals (CBCA);
conducting internal investigations relating to various government contracting issues and defending clients in Department of Justice (DOJ) and inspector general investigations;
advising clients in the negotiation of teaming and subcontracting agreements and prime-subcontractor disputes and on issues of small business subcontracting compliance;
advising clients regarding cost allowability issues and compliance with the Cost Accounting Standards (CAS);
advising clients on federal procurement compliance issues, including business ethics, organizational conflicts of interest, gifts and gratuities and mandatory disclosure rules; and
representing clients in anti-dumping and countervailing duty matters, scope review requests, new shipper reviews and circumvention proceedings before the Import Administration and the U.S. Court of International Trade.

Katie is also an active member of the American Bar Association Section of Public Contract Law. She serves as the Vice-Chair of the Accounting, Cost and Pricing Committee and the Young Lawyers Committee. She recently helped coordinate a panel on hot topics surrounding insurance coverage issues that are unique to government contractors and a separate panel on how to quantify government contract claim damages. She also frequently authors articles for the firm’s Government Contracts, Investigations and International Trade blog on emerging issues in government contracts cost accounting.

Experience

Bid Protest Experience:

Successfully represented Deloitte Consulting LLC in a GAO bid protest challenging the Defense Health Agency’s award of a $53.5 million contract to PricewaterhouseCoopers for process improvement and integration services for the Military Health System (Deloitte Consulting, LLP; Booz Allen Hamilton, Inc.; CALIBRE Systems, Inc., B-411844, et al.).
Successfully defended a bid protest challenging the Army Corps of Engineers’ award of an $8 million contract for environmental remediation services (EA Engineering, Science, and Technology, Inc., B-411967.2, et al.).
Successfully defended a bid protest challenging the Department of Energy’s award of a $130 million contract to manage and operate the Transuranic Waste Processing Center (Aerostar Perma-Fix TRU Services, LLC, B-411733, B-411733.4, 2015 CPD ¶ 338).
Successfully defended a bid protest challenging the Department of Labor’s award of a $44 million contract to operate the Kittrell Job Corps Center in Kittrell, North Carolina (Del-Jen Education & Training Group / Flour Federal Solutions, LLC, B-406897.3, 2014 CPD ¶ 166).
Successfully defended a bid protest challenging the Air Force’s award of a $45 million contract to produce joint munitions effectiveness manuals tools and related publications required by the Joint Technical Coordinating Group for Munitions Effectiveness (Oklahoma State University, B-406865, 2012 CPD ¶ 276).
Represented contractors in a series of pre-award bid protests challenging the Department of Labor’s small business set-aside decisions before the U.S. Court of Federal Claims and the U.S. Court of Appeals for the Federal Circuit.
Obtained corrective action in numerous other bid protests in which the government improperly conducted the procurement process and acknowledged the errors before proceeding to a decision on the merits.

Litigation Experience:

Currently representing a major government contractor in ongoing litigation before the U.S. Court of Federal Claims involving large, complex claims and government counterclaims related to the performance of an $874 million contract with the U.S. Postal Service.

International Trade Experience:

Represented a U.S. importer of magnesium carbon bricks in a scope review request before the Import Administration.
Represented Chinese manufacturers in new shipper review proceedings before the Import Administration.
Represented a U.S. importer of graphite electrodes in a circumvention proceeding before the Import Administration and the U.S. Court of International Trade.
