Antitrust in Asia: Hong Kong

Antitrust enforcement in Asia has taken a prominent and increasingly important place in the global competition ecosystem. This ABA Antitrust Section sponsored conference features leading enforcers from China, Hong Kong, India, Japan, Singapore, South Korea and the U.S., academics, and practitioners who will address key developments across the Asia-Pacific region, as well as provide conference attendees unique opportunities to interact with top policy-makers. Topics include: compliance with established and emerging competition regimes in Asia; similarities and differences in competition law and policy across the region; how Asian competition regimes engage in merger review, cartel enforcement, intellectual property and abuse of dominance analysis; and rights and remedies in private litigation.

Sheppard Mullin Special Counsel Becky Koblitz of our Beijing office will be speaking on the "Non-Competition Factors in Asian Competition Analysis" panel, with Randolph Tritell (Director, Office of International Affairs, Federal Trade Commission, Washington, DC), Dimos Dakanalis (Chief Antitrust Counsel, Oracle Corporation, Brussels), Sonia Pfaffenroth (Deputy Assistant Attorney General for Civil Enforcement, U.S. Department of Justice, Antitrust Division, Washington, DC) and Angela Zhang (Kings College, London). The session is described as: Competition analysis sometimes explicitly or implicitly includes economic and social considerations that are not clearly aligned with promoting competition in the marketplace. The presence of such non-competition factors creates substantial difficulties and uncertainties for companies doing business in Asia. Panelists will discuss the most important non-competition considerations, the role they play in the analysis and how to address these considerations in merger and conduct cases.
