With Viking River Cruises and Adolph v Uber in the rearview mirror, this panel will explore the fallout from those decisions and the landscape of wage-and-hour arbitrations going forward.  Panelists from both the plaintiff and defense perspective will discuss how to draft an arbitration agreement that will stand the test of time (and how to attack it), how to arbitrate an “individual PAGA claim,” what happens when the employer fails to pay arbitration fees in a timely manner, and the upsides and downsides of arbitration for both plaintiffs and defendants in a wage-and-hour case.
