Join us to learn the art of trying a False Claims Act case to a jury verdict. Be a part of the experience, watch experienced plaintiff and defense counsel make their opening statements, present and argue the evidence, all before a sitting federal judge and a jury. Then, watch how the jury evaluates the evidence and arguments of counsel, as the jury deliberations are live-streamed to the audience.

It is increasingly difficult to find opportunities to observe a trial and even more difficult to observe jury deliberations. Conducting a mock jury exercise is time-consuming and expensive. This mock FCA trial, from voir dire through jury deliberations, which attendees will be able to observe live and via video also allows attendees to discuss the trial with the attorneys, jury consultants, and the mock jurors. Short of an actual trial, there is simply no better opportunity to observe the trial process from the inside. This Institute offers the benefits of a mock jury exercise at a fraction of the cost.

David Fischer will be hosting the panel "FCA Family Feud – Let’s Play the Feud!" on January 14 from 4:15-5:15 PM.

  • The Family Feud comes to the ABA FCA Trial Institute! Prior to the conference, we surveyed FCA attorneys about a range of FCA issues. Now, two teams go head-to-head to see who really knows the most about the False Claims Act, in this fun, fast paced, and entertaining program.

David Douglass will be speaking on the panel " Defense Case Begins (or continues)" on January 15 from 3:30-5:15 PM.

  • After the plaintiff closes its case, the defense calls its witnesses on direct examination, and the plaintiff cross-examines them. The defense can now introduce evidence to help convince the jury it should not find for the plaintiff. One of the defense’s witnesses will be an expert witness. The defense witness examinations illustrate how each side’s tactics, strategies and communication techniques change when the case shifts from the plaintiff’s case-in-chief to the defendant’s case-in-chief.
