Overview
Mosby Perrow represents electric, pipeline, and renewable energy companies on regulatory and transactional matters with extensive experience before the Federal Energy Regulatory Commission (FERC) and the Department of Energy (DOE). He specializes in complex energy projects and regulatory proceedings that require expertise in and coordination between legal, governmental, and regulatory strategies and execution. Mosby has served as first-chair counsel in rate, certificate, and enforcement proceedings before federal agencies, and previously served as Vice President and Deputy General Counsel at Kinder Morgan, Inc. Mosby began his career as an attorney advisor at FERC.

Pipeline and LNG
- Advise senior leadership at major energy infrastructure companies on critical federal laws, policies and developments that affect development, operations and strategies driving profitability.
- Represent natural gas pipeline companies in certificate proceedings before the FERC, including advising on creative structures, expedited timelines and contested proceedings.
- Represent natural gas pipeline companies in rate proceedings before the FERC, including advising on pre-file settlements, multi-party negotiations and contested proceedings resulting in favorable settlements.
- Represent LNG terminals in a variety of regulatory proceedings and policy initiatives before the FERC, DOE and reviewing courts.
- Represent pipelines, LNG operators, producers and marketers in enforcement actions, non-public investigations and audits resulting in favorable no-action or significantly reduced penalties. These engagements often include conducting and advising on internal investigations, drafting or revising compliance handbooks and protocols and working with senior management and executives on identification and prevention measures.
- Provide training for pipeline personnel on energy regulatory and legal requirements and compliance obligations, including anti-market manipulation developments, Standards of Conduct, transportation and tariff rules and enforcement updates.
- Represent intrastate pipelines in non-jurisdictional projects, including joint venture negotiations, jurisdictional counseling, establishing rates under Section 311 of the NGPA, developing Hinshaw facilities and negotiating transportation, gathering and processing agreements.
- Represent gathering and processing companies on agreements, asset purchase agreements and regulatory issues.
- Advise crude gathering system on requirements under the FERC’s ICA jurisdiction.
Electric
- Advise public utilities, developers and investors on mergers and acquisitions involving FERC jurisdictional facilities, including obtaining timely FERC authorization under FPA Section 203, writing legal opinions on legal and regulatory compliance, interlocking directorates and analyzing related contracts, tariffs and rates.
- Represent independent power producers on market-based rates, exempt wholesale generator status, and qualified facility statues.
- Represent public power in standing up new renewable energy subsidiary, advising on energy regulatory and legal matters.
- Represent large generation owners and operators on regulatory and compliance issues in ERCOT, including those associated with mergers and acquisitions.
- Represent transmission developers, owners and operators on tariff and rate issues, establishing and revising formula and market-based rates, obtaining incentive rates and complying with regulatory requirements in organized markets across the country.
- Advise public utilities, developers and investors on rules, regulations, policies and other requirements associated with participating and investing in generation and transmission located in FERC-regulated organized markets, including PJM, SPP, NYISO and MISO.
Energy Transition
- Provide transactional and regulatory expertise on renewable energy developments and acquisitions, including wind, solar and battery storage projects.
- Represent developers, producers and end users on legal and regulatory issues related to renewable natural gas.
- Advise developers and other clients on hydrogen projects and hubs development, including policy considerations, the regulatory landscape, joint development agreements and funding opportunities with state and federal governments, including the DOE.
- Represent clients on carbon capture and sequestration projects, including commercial agreements and funding agreements supporting those projects.
