Court Issues Favorable Trademark Infringement Order For Sheppard Mullin Client, Osotspa

Sheppard, Mullin, Richter & Hampton LLP is proud to announce its team headed by Craig Cardon , San Francisco/Century City-based intellectual property partner, obtained a nationwide preliminary injunction on behalf of client Osotspa Co., Ltd. Cardon was assisted by attorneys Brian Blackman and Krista Mitzel.

The United States District Court for the Southern District of Florida issued a nationwide preliminary injunction against an Osotspa competitor in the energy drink market. The July 15 order affirmed an April report and recommendation from a magistrate.

Osotspa manufactures Shark energy drink. The company's competitor, Impulse Beverage Inc., uses a shark logo design similar to Osotspa's registered trademarks. The injunction essentially shut down Impulse Beverage until it changes its cans, trucks and advertisements.

"Osotspa, the largest Thai pharmaceutical company, is pleased that two separate judges in the U.S. Courts have recognized its intellectual property rights. The Shark drinks may now compete in the U.S. market without competing against an attempted misappropriation of its own brand. This case is another example of Sheppard Mullin's abilities to prosecute trademark and other infringement actions for companies from all over the world in any Court in the United States," commented Cardon.
