Khirin Bunker is an associate in the Business Trial Practice Group and the lead associate for the firm’s Food & Beverage Industry team. He is also a member of the firm’s Retail, Fashion & Beauty and Class Action Defense Teams.

Areas of Practice

Khirin focuses his practice on complex business litigation and consumer class actions. He represents clients in a broad range of industries, including retail, cosmetics, food and beverage, supplements, over-the-counter drugs, fashion, lending and technology.

Khirin helps clients resolve breach of contract, fraud, misrepresentation, negligence, unjust enrichment, breach of warranty, and lender liability claims. On the class action side, he defends against alleged violations of California’s Unfair Competition Law, False Advertising Law, Consumers Legal Remedies Act and similar alleged violations of other states’ laws, including New York General Business Law Sections 349 and 350, the Illinois Consumer Fraud and Deceptive Business Practices Act, and Florida’s Deceptive and Unfair Trade Practices Act. He frequently counsels clients who receive pre-litigation demand letters alleging products and services are misleadingly advertised and has successfully defeated class action lawsuits at the pleadings, summary judgment, and class certification stages.

Khirin is involved with all phases of dispute resolution, from pre-litigation evaluation and assessment through trial and appeal in state and federal court and in arbitration.

  • Represented throat drop manufacturer in a class action accusing it of false advertising. Prevailed on motion for summary judgment and defeated class certification.
  • Represented throat drop manufacturer in a class action accusing it of false advertising. Prevailed on motion for judgment on the pleadings.
  • Represented throat drop manufacturer in a misleading packaging class action. Prevailed on motion to dismiss.
  • Represented nationwide restaurant chain in a class action accusing it of false advertising.
  • Represented supplement manufacturer in a class action accusing it of false labeling and advertising.
  • Represented beverage retailer in a false advertising class action. Prevailed on motion to dismiss.
  • Represented cosmetics manufacturer in a false advertising class action.
  • Represented toy manufacturer in a class action accusing it of misleading packaging.
  • Represented energy bar manufacturer in a class action accusing it of misleading packaging. 

Other Representative Actions:

  • Represented national solar lender in various consumer disputes. Prevailed on numerous motions to compel arbitration in state and federal courts.
  • Represented construction development firm in former LLC member dispute. Prevailed in arbitration on affirmative claims and defeated all counterclaims resulting in attorneys’ fees award of over $775,000. Final arbitration award confirmed and upheld on appeal by the California Court of Appeal.
  • Represented international news agency in third-party subpoena dispute involving demands for confidential agreements and communications. Prevailed in defending against motion to compel production.
  • Represented luxury fashion house against second-hand reseller for willful trademark infringement, counterfeiting, false association, and false advertising.
