Last month, the U.S. District Court for the District of Columbia  vacated the Centers for Medicare and Medicaid Services’ overpayment rule for the Medicare Advantage Program. The decision is important for what it means and doesn’t mean for MAOs, as well as for pending False Claims Act cases. Providers should also understand the implications of the court’s decision, since CMS’ separate overpayment rule for providers has many of the same flaws as the MA overpayment rule.
