  • Significant developments and predictions for the year ahead in antitrust enforcement in healthcare with particular emphasis on competing legislative and enforcement views on vertical integration, provider price transparency and drug pricing.
  • The CMS proposed rule, that if finalized, would fundamentally change and alleviate the manner in which the Stark Law regulatory framework has traditionally applied. This proposed rule should be of interest to healthcare institutional and individual providers alike, as it would open up tremendous opportunities to enter into value-based arrangements as well as more traditional hospital-physician financial relationships that CMS has come to realize present minimal risk of program fraud and abuse.
  • Developments in FDA law and policy in reaction to the rise of emerging technologies (e.g., artificial technology) and product markets (e.g., cannabis) in the healthcare and consumer spaces.
  • The outlook for the Affordable Care Act for the remainder of the first term of the Trump Administration. We will also review key developments and trends at the Federal and State levels and their impact on how healthcare and coverage will be delivered in 2020 and beyond.
