Sheppard Mullin’s antitrust litigation team has a well-earned reputation for determined, pragmatic, and effective client advocacy in some of the nation’s most high-profile antitrust cases. With our aggressive, cost-effective, and results-driven approach to litigation, we have a demonstrated track record of success extricating our clients from antitrust lawsuits, often at early stages (e.g., motions to dismiss or motions for summary judgment). In those matters where early dismissals may not be possible, our reputations as fierce but fair antitrust litigators enable us to obtain steeply discounted and favorable settlements.

We litigate some of the largest and most complex antitrust cases in the U.S., from federal multi-district class actions brought by direct or indirect purchasers, to opt-out lawsuits brought by large individual purchasers, to other types of civil litigation involving competitors, suppliers, or purchasers. Under both state and federal antitrust laws, private parties can bring antitrust claims seeking treble damages, injunctive relief and recovery of attorneys' fees. Such lawsuits may assert a variety of antitrust violations such as price fixing, price discrimination, distribution restraints, monopolization, so experienced counsel is important. We also have deep experience with litigation arising under state antitrust and competition laws, including consumer protection and unfair competition statutes. Our attorneys handle litigation involving the federal Sherman, Clayton and Robinson-Patman Acts, as well as corresponding state antitrust and consumer protection statutes.

We have represented various defendants in many of the most significant antitrust class actions in the country. These include actions relating to vitamins, wholesale electricity, DRAM, SRAM, LCD, and CRT. In addition, we have defended—and prosecuted—monopolization and merger cases representing clients in industries ranging from sports to newspapers.
